1. Taxes and Duties:



All taxes and duties applicable at the load port are in sellers account and at the discharge port



are to the buyers ‘account



2. Confidentiality:



All parties related to this pre-contract agree to keep the provisions and terms of this contract



strictly confidential



3. Force Majuere:



During the tenure of the contract if a situation of force majeure occurs due to natural



calamities, civil disturbance, commotion, riots and any other acts of God or manmade then



either party must inform the other within 7 days of such occurrence and if the situation



persists for 30 days or more the contract shall be deemed to be null and void without any



liabilities on either side.



4. Jurisdiction:



All parties agree to attempt to resolve all disputes in connection with the contract in the



course of execution through friendly discussion. if a dispute cannot be resolved in the above



manner, then the dispute is to be settled in South Africa, as per the arbitration laws of



international chamber of commerce. all fees and or charges incurred shall be to the loosing



party’s account, unless agreed otherwise.
